Bhubaneswar, Feb 1: The Housing & Urban Development (H & UD) Department, Govt of Odisha, has issued a clarification Saturday regarding the Odisha Apartment (Ownership And Management) Act 2023.
The Odisha Apartment (Ownership And Management) Act (Odisha Act 7, 2023) came into effect June 28, 2023.
The H & UD Dept has requested the Odisha Revenue & Disaster Management Department to register all the apartments which have been completed before February 25, 2017, under the Odisha Apartment (Ownership and Management) Act.

What is Odisha Apartment (Ownership And Management) Act 2023?
This is an act to consolidate the laws relating to ownership of an individual apartment in a building with an undivided interest in the common areas and facilities and to provide for better management of such apartment and for matters connected therewith or incidential thereto.
Act says, "The provisions of this Act shall apply to all apartments or buildings converted into apartments irrespective of whether their construction made before or after the date of commencement of this Act on a free hold land or on a lease hold land, if the lease for such land is for a period of thirty years or more including the sub-lease."
"All apartments used or proposed to be used for residence, office, practice of any profession or for carrying on any occupation, trade or business or for any other type of independent use shall be governed by the provisions of this Act.
"The provisions of this Act shall not apply to a building used for the purpose of holding office or otherwise of a Department of Government or of a Government undertaking or where the building is owned and used by the owner by himself or for letting it out to others," adds the 'Applicability' section of the Odisha Apartment (Ownership And Management) Act 2023.
Crucial responsibility for senior officers
In another development, seven senior officers have been specially assigned to expeditiously dispose of the appeals pending against the orders issued from time to time regarding the functioning of Odisha Development Authoritie Act 1982 in BDA and BMC.
The department has said that there is an urgent need to dispose of more than 700 pending appeals keeping the interest of the common men in mind. The assigned officers have been directed to dispose of the pending appeal cases at the earliest.
